marriageAfter a two day hearing at Leeds Crown Court, the Recorder of Leeds, Judge Peter Collier QC, sitting with two magistrates, yesterday dismissed Medley's appeals against two of the charges involvingdamage to his wife's clothes valued at 4,000 and to 3,000 of her sister's clothing.But the court allowed his appeal against the third charge of damaging handbags, belts, shoes and boots valued at 1,000 belonging to his 46 year old wife. Judge Collier confirmed the sentence ofthe magistrates, which had been suspended pending the appeal, of 120 hours' unpaid community work, with 200 costs and 3,000 compensation to Mrs Wellings. He was also ordered to pay 650 costs.Medley told the court he had not burned the clothing, though he admitted putting his wife's underwear in bin bags and hiding them from her.He claimed the fire in the incinerator was already burning when he arrived home but could not explain who had started it. Judge Collier said the court was satisfied Medley lit the fire.Medley had been seen by a neighbour, with items draped over his arm which he dropped one by one into the incinerator.He claimed he only stoked the fire by putting business documents and newspapers on it. But Judge Collier said: "We are driven to the conclusion he has not told us the truth about that."The judge said they also concluded Medley had lit the fire and put the items of clothing on it. He added: "We are satisfied beyond doubt he decided in anger to burn them in the incinerator andthat is what he did."Medley, who had been married 13 years, was alleged to have destroyed one shoe of each pair his wife owned and is said to have taunted her while they were separated by saying Heather Mills andGareth Gates had some of them.He was said to be enraged when his wife confessed to selling the private registration plates on his Ferrari.Medley told the court Jane's sister could have gone to an Oxfam shop in Ilkley to buy a bra to throw on to the fire in order to "fit him up".But Judge Collier said: "We entirely reject that allegation as we reject the other allegations he has made that amount to a conspiracy on the part of his former wife and her family."He said the court was satisfied the footwear
